Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and DVCKS1 LLC, doing business as DivinityCoin, an Indiana limited liability company ("Company," "we," "us," or "our"). By accessing or using the DivinityCoin website and services (collectively, the "Service"), you agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use our Service. You must be at least 18 years of age, or the age of majority in your jurisdiction, to use this Service. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian.

3. Service Description

DivinityCoin provides a digital credit purchase service. Users can purchase credits that can be redeemed on partner platforms to support creators and content providers. We act as an intermediary between purchasers and partner platforms. The credits purchased through our Service function similarly to gift cards or stored value cards under applicable Indiana and federal law.

4. Purchases and Payments

All payments are processed securely through Stripe, a PCI-compliant payment processor. We accept major credit and debit cards. All prices are displayed in United States Dollars (USD). By completing a purchase, you authorize us to charge your selected payment method for the total amount of your order.

We do not offer payment plans, financing, layaway, or pay-over-time options. All purchases must be paid in full at the time of transaction.

In accordance with Indiana Code § 24-4-8 (Indiana Gift Card Act), our credits do not expire and are not subject to inactivity fees.

5. Credit Terms

  • Credits are issued as unique codes delivered via email to the address you provide
  • Each code can only be redeemed once
  • Codes are non-transferable after redemption to a partner platform account
  • Credits have no cash value and cannot be exchanged for cash, except as required by applicable law
  • Credits do not expire in accordance with Indiana law
  • No dormancy, service, or inactivity fees will be charged
  • Lost or stolen codes cannot be replaced once redeemed; unredeemed codes may be replaced with proof of purchase
  • You are responsible for safeguarding your credit codes

6. Redemption

Credits are redeemed on partner platforms according to their respective terms and conditions. DivinityCoin is not responsible for the services, content, availability, or policies of partner platforms. Once credits are redeemed to a partner platform, any disputes regarding the use of those credits must be resolved with the partner platform directly.

7. Refunds

Unredeemed credits may be refunded within 30 days of purchase, subject to our refund policy. Redeemed credits are non-refundable as the value has been transferred to a partner platform. See our Refund Policy for complete details and instructions on requesting a refund.

8. Prohibited Uses

You agree not to:

  • Use the Service for any fraudulent, illegal, or unauthorized purpose
  • Attempt to exploit, hack, probe, or reverse-engineer the Service or its systems
  • Resell, redistribute, or commercially exploit credits without express written authorization
  • Violate any applicable local, state, federal, or international laws or regulations
  • Violate the terms of service of our partner platforms
  • Use the Service to launder money or finance illegal activities
  • Attempt to circumvent any security measures or access controls
  • Impersonate any person or entity or misrepresent your affiliation

9. Intellectual Property

All content, trademarks, service marks, logos, and intellectual property associated with DivinityCoin and DVCKS1 LLC are owned by us or our licensors and are protected by United States and international intellectual property laws. You may not use, copy, reproduce, or distribute our branding, logos, or proprietary materials without our prior written permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY INDIANA LAW, DVCKS1 LLC AND ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless DVCKS1 LLC, its members, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your violation of any applicable law.

13. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through the courts as specified in Section 14.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, United States of America, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Marion County, Indiana for the resolution of any disputes arising out of or relating to these Terms or your use of the Service.

15. Changes to Terms

We reserve the right to modify these Terms at any time in our sole discretion. If we make material changes, we will notify you by posting the updated Terms on our website with a new "Last Updated" date, and for registered users, we will send notification via email. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and DVCKS1 LLC regarding your use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
